SHORT TERM VACATION RENTAL AGREEMENT

This Rental Agreement (the “Agreement”) is made by and between EHM Rentals, Inc. (the “Company”) and the Renter for the rental of the vacation rental property (the “Property”).

RENTAL PERIOD
As per confirmed reservation (“Rental Period”).

MAXIMUM NUMBER OF OCCUPANTS
As per confirmed reservation and the Property details on the Company website.

INITIAL DEPOSIT
An initial deposit of 20% of the rental charge is due and payable by the Renter at the time of booking.

REMAINING BALANCE
The balance of the rental charge, the sales taxes, the security deposit and any other charges are due and payable by the Renter eight weeks prior to the arrival date. Once full and final payment has been made the Company will provide the Renter with access details for the Property. Where the booking date is less than eight weeks from the Renter’s arrival date the total booking cost and the security deposit are due and payable in full.

SECURITY DEPOSIT
The security deposit, net of deductions, if any, will be returned to the Renter within 20 business days after the end of the Rental Period. Deductions from the security deposit may include, but are not limited to: damage to the Property and its contents, inventory shortages, excess departure cleaning or laundry costs, excess utility usage and any other costs or fees associated with the Renter’s breach of this Agreement.

CANCELLATIONS AND REFUNDS
If the Renter wishes to cancel the booking, the Renter must inform the Company immediately by telephone, to be followed by written confirmation. Refunds will be made as follows:

Written cancellation received more than 8 weeks prior to arrival date – full refund of monies paid to Company
Written cancellation received between 6 and 8 weeks prior to arrival date – 50% of rental paid to Company
Written cancellation received within 6 weeks of arrival date – no refund of rental paid to Company

If the security deposit, maid service fee and pool/spa heating charge have already been paid, the Company will refund these to the Renter.

In the event that the Company is forced to cancel the Renter’s booking due to events outside the Company’s control, the Company reserves the right to cancel the booking at any time and will only be liable to refund monies already paid by the Renter.

Renter acknowledges that Renter has read, understands, accepts and agrees to abide by this Agreement, which includes “Important Information About Your Stay”

Important Information About Your Stay

Please read carefully the following information about the Agreement and your stay

CHECK IN / CHECK OUT
Check-in is after 4 pm on the first day of the Rental Period. Check-out is before 11 am on the last day of the Rental Period. Please note that unless previously agreed by the Company, early check-ins or late check-outs will result in one full day’s rent being charged against the Security Deposit.

RENTER RESPONSIBILITY
The Renter executing this Agreement must be at least 25 years of age, must occupy the Property throughout the Rental Period, and will be held responsible for all other occupants of the Property for compliance with this Agreement. Reservations made under false pretenses will be subject to forfeiture of all monies paid.

RETURNED CHECKS
Returned checks will be subject to a $40 service charge.

MAINTENANCE
Please report any maintenance needs for the Property to the Company. While we apologize for any inconvenience of a mechanical failure or utility outage, we will not be able to offer a discount or refund.

CARE OF THE PROPERTY
In the event of breakages, losses or damage to the Property, Renter must inform the Company immediately. Renter may be liable to pay the full cost of any breakages, losses or damage to the Property. Please take good care of the Property during your stay and leave it in a clean and tidy condition on the day of departure. Please clean the BBQ thoroughly before departure.

ENTRY BY COMPANY
Company’s employees or agents may enter the Property during the Rental Period in cases of emergency or to make any necessary repairs. Company will notify Renter with at least 24 hours notice of Company’s intent to enter the Property, except in cases of emergency.

RULES AND REGULATIONS
The Security Deposit may be forfeited and the Renter may be asked to vacate the Property immediately, with no refund, for a breach of this Agreement, which includes the failure to follow the rules below:

• Smoking of any kind inside the Property is prohibited
• Except by prior agreement, pets are NOT allowed in the Property or on site
• Large house parties or excessive noise are not allowed.
• The reservation confirmed number of people staying on the Property may not be exceeded
• Do not interfere with the pool or pool heat equipment.
• Do not have or use fireworks, firecrackers on the Property or on site
• No furnishings or equipment may be removed from the Property
• All applicable laws and neighborhood deed restrictions must be observed.
• Do not leave windows and doors open while the air conditioning is on as this may cause the HVAC units to freeze up and not work properly.

INTEREST BEARING ACCOUNT
Deposits and rental monies may be placed in an interest bearing account with any interest accruing to the Company.

POOL AND PROPERTY SAFETY
For the safety of all, the Renter must keep the pool area under supervision at all times to prevent unaccompanied children and non-swimmers from access. All pool, deck, steps and other areas of the Property can be slippery when wet. Renter is responsible for the safety of all occupants. The Renter will ensure that all occupants strictly observe all pool rules, which forbid any diving, jumping or running around the pool. The Renter understands and assumes the risk that failure to abide by safety rules is a breach of this Agreement and may result in serious injury or death.

KEYS
After receipt of all booking charges, the Company will provide to the Renter the code to the lockbox on the Property containing keys.

TELEPHONE USAGE
All local calls are free. Long distance calls can be made using a calling card or pre-paid card.

PROPERTY FOR SALE
If the Property is placed on the market for sale, the Renter agrees to allow the Property to be shown to prospective buyers during the Rental Period upon reasonable notice being given.

SHORT-TERM RENTAL
It is expressly understood and agreed that this is a short-term vacation rental under the provisions of Chapter 509, Florida Statutes, and is not a lease or other long term residential tenancy agreement. This Agreement is only for the licensed use of the Property for the stated Rental Period. It creates no property rights in Renter and confers no rights to renewal or for recurring usage.

NO ASSIGNMENT OR SUBLETTING
Renter may not assign or sublease all or part of this Agreement.

INDEMNIFICATION, RELEASE OF LIABILITY AND HOLD HARMLESS
The Renter hereby agrees to indemnify, release and hold harmless Company and Company’s officers, shareholders, employees and agents from and against any and all claims, damages, lawsuits, costs and expenses arising from loss, damage or injury to any person or property occurring on the Property.

GOVERNING LAW AND VENUE
This Agreement will be governed by and construed in accordance with the laws of the State of Florida. Any litigation arising out of this Agreement shall be brought in a court of competent jurisdiction in Charlotte County.

COMPLETE AGREEMENT
This Agreement contains the entire agreement between the parties and there are no other promises, terms or conditions, whether oral or written, other than contained herein.
